Please review this agreement carefully. By accessing the website (“site”) including through a mobile application, you (herein at times may be referred to as “member,” “user” or “you”) agree to be bound by these Terms of Use (this “agreement”) whether or not you register as a member of the site. Herein the site may be referred to at times as (the “company’s website,” “site,” “Canny Credit Repair” and “Canny”). Please read this agreement carefully. You are required to accept these terms of use to use the website.

This agreement is between you and Canny and is required before you can use the services of the site. To use the site, you agree and accept to be bound by all terms and conditions of this agreement and if you do not agree to meet or comply with the terms and/or provisions set-forth, do not use the website and/or the service of the site.

Any unlawful use of the website, private and/or commercially including fraud are prohibited and arbitration provision which describes how disputes (defined below) will be resolved between Canny and that no class action may be brought under this agreement. In order to proceed with this agreement and to access the services of the website, you must acknowledge and agree to be bound by the terms of this agreement, including the acceptable use limitations and arbitration provision described herein.

The site is a self-help service, where the user does the work themselves by utilizing the steps and/or filling-in the blank data fields with the necessary business or personal information. The site provides a set of tools and strategies for you to challenge and/or remove certain creditors, debts, errors, and harmful misleading derogatory information listings (accounts and/or items) that appear on a consumer’s credit report. By accessing this site, you agree that you must file your own dispute forms either using the tools set forth provided by the site or by other means you will provide. Herein the word self-help is defined by (doing it yourself) in this agreement.

Binding Agreement

This agreement is an electronic contract that sets out the legally binding terms you must accept to use the website and to subscribe as a member user of the site. For purposes of the agreement, the terms (“member” or “ subscriber”) means a person who provides information to the company by use of the website to participate in utilizing the forms and or tools the service provides in any manner whether such person uses the service of the site as a free member or a subscriber. This agreement may be modified by Canny at its sole discretion at any time and any such modifications will be posted on the website. Upon posting of modification, your continued use of the website or service after any modification will constitute your acceptance of such revisions.

This agreement includes Canny Acceptable website use policy for content as herein defined posted on the site (Important Disclaimers) and here the agreement may be referred to as the site (Privacy Policy) any notices regarding the website and terms disclosed and the agreed to by you becoming a member or if you used the service as stated-specifically no users personal information will be or is stored, saved or viewable by any employees, staff, or owner’s of the company. Our acceptable website use policy and privacy policy are incorporated into this agreement and any other notices and terms presented to you and accepted by you (either directly or by used of the service) are incorporated in these terms as well).

Eligibility

You must be at least eighteen years old to use or be a member of the site. By using the website, you represent and warrant that you have the right, authority and capacity to enter into this agreement and to abide by all of the terms and conditions of this agreement and policy.

Terms and Termination

This agreement will remain in full force and effect while you use the service of the website and/or are a member. You may terminate your membership subscription at anytime, for any reason. The site and/or owners or company may terminate a user’s membership for prohibited use of the site or services. You will not be entitled to any refund of unused subscription fees or unused credit. If your membership is terminated for any reason, all terms of this agreement survive such termination and continue in full force and effect except any terms that by their nature expire or are fully satisfied.

Non-Commercial Use by Subscribers

The website and the service are for personal use only. Any other use, including use by competitors and the media is considered commercial use by commercial users. Any commercial  use must be granted by the company and the user must present the commercial use in its entirety to the company before any commercial endeavors are affordable for public viewing such as (i) advertising or soliciting the commercial use to any one person, and/or business, corporations, or to sell any products or services of the site, the name, logo, or bearing such on any product is unauthorized. (ii) Members cannot use the service or the website for any purpose illegal and/or unauthorized use of a user’s user passcode would result in the user’s termination of use of the site. The company may investigate any user misuse of the site and take any available legal action if necessary in response to illegal and/or unauthorized use of the website, including referring activities that the company deems suspicious to governmental authorities.

Account Security Policy

Your membership account information is for you and your personal use only. You are solely responsible for maintaining the confidentiality of your username and passcode that you designate during the subscriber registration process. You are solely responsible for all activities that occur under your username and passcode, including distribution of your personal information to a third-party user. For example, you have someone you trust access the site using your username and passcode you provided to the site, that person is filling out the forms using the personal information you provided them. That person then saves or writes down your username and passcode to access the site at a later date and uses the service on behalf of themselves or uses your personal information for something else. You acknowledge that Canny is not responsible for third-party access to your account information or personal information that results from voluntary distribution or theft or misappropriation of your username and/or password or personal information.

Risk Assumption

You understand that Canny makes no guarantees either expressly or implied regarding repairing your credit and/or credit score. The site only provides a clear correspondence format method and forms for you to use to submit to the credit bureaus, collection agencies or creditors in order to challenge and/or remove listings that may be causing you to have bad credit ratings, or errors that may appear on your report. Herein the word report may be at times used as (“credit report” or “report”) and that you agree that the company is not repairing your credit report for you, nor the site or the service, but instead you are repairing your report yourself and solely utilizing the tools the site or service offers.

Proprietary Rights

Canny Credit Repair, Inc owns and retains all proprietary rights of the website and the service and of all content, trademarks, trade names, service marks, and other intellectual property rights related thereto. The website contains the copyrighted material, trademarks, and other proprietary information of Canny. Except for that information that is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute other than what the site has authorized for personal use.

Acceptable Website Use

The website may be used only for lawful purposes. As one of the condition of your use of the site and service, you represent, warrant and agree that you will not use, plan, encourage or assist others to use the website or service for any purpose or in any manner that is prohibited by this agreement or by applicable law. It is your responsibility to ensure that your use of the site and service complies with this agreement and to seek prior written consent from the site for any uses not permitted or not expressly specified herein. Canny specifically prohibits any use of the website or the service, and you hereby agree not to use the website or the service, for any use other than your own self-help credit repair. The site provides three separate plans, which grant users access to specific tabs in each plan by paid subscription. You agree to no fees or charges are rendered up front to repair your credit report. The service fees are for usage access to the website or services during the duration of your subscriber term expiration date. If you use the website in a way that is not authorized or is illegal, we may take any legal action deemed against you and/or refer you to the proper law enforcement authorities. 

Subscription and Membership

You must provide current, complete and accurate information for your billing account. You must promptly update all information to keep your billing account current, complete and accurate such as a change in billing address, card number, or expiration date, and you must promptly notify Canny Credit Repair if your payment method is cancelled including if your credit/debit card is lost or stolen,  you become aware of a potential breach of security such as unauthorized disclosure or use of your username or password. If you fail to provide us any of the foregoing information, you agree that you are responsible for fees accrued under your billing account.

You agree that all payments made on the website are final and you will not challenge or dispute the charge with your bank. You further agree that should you have any issues relating to your payment such as duplicate billing you will contact the website to resolve the issue. Should a dispute be initiated with your bank, you agree that you will be held responsible for any outstanding balance owed to Canny plus any dispute case fees charged by our bank. You agree that you will pay any outstanding balance you have with us within 30-days from the date of notification. Any outstanding balance left unpaid after the 30 days may be submitted to a collections agency and you agree that a collection fee of up to 50% of the outstanding balance or $100.00 whichever is higher will be added to the owed amount.

Canny provides an automatic renewal in order to provide continuous service. You agree, whether it exercises the right or not, Canny has the right to automatically renew your membership from month to month for the exact same membership plan UNTIL TERMINATED. Canny may automatically renew all paid subscriptions for the services on the date such subscriptions expire. This may occur after your initial subscription commitment period and again after any subsequent subscription period. Your subscription will automatically continue for an additional equivalent period. By entering into this agreement, you acknowledge that your account will be subject to the above described automatic renewals. If you do not wish your account to renew automatically, or if you want to change it or terminate your subscription, please log into the Account tab on the site and follow the directions therein.

Canny Credit Repair maintains a strict NO REFUND POLICY all purchases made on the website are final. If you choose to purchase a subscription plan package on the site you agree that absolutely no refunds, either full or partial will be issued for any reason or for any unused or remaining subscription or credits.

When you deactivate your account or if your account is suspended for violating this agreement or any other policies on the site, you agree that any remaining or unused subscription and/or credit will be forfeited and no refunds will be issued for any remaining or unused subscription and credits. You further agree that if your account is deactivated and then reinstated at a later date, you agree that any remaining or unused subscription and credits remaining at the time of your deactivation will not be reinstated with your account. You agree that credits or a subscription purchase for a specific account plan or account is strictly non-transferable. You agree that any remaining or unused subscription associated with an active or deactivated account will not be transferred to any other membership account belonging to you or someone else.

Canny reserves the right to offer free or discounted membership to any person(s) of its choice at any given time, for any duration, while charging other members at the same time. Also, Canny reserves the right to cancel the free trial period or discounted period at any time, for all or any of its members. You accept and agree to all the subscription and membership terms provided herein as a user of CannyCreditRepair.com.
